Article 1. Conditions of access to services

Browsing the site is open to all. Access to certain services is subject to the creation of a customer account. To register and become a customer of the site, Internet users can register on their own initiative by providing some of their contact details. You will then have access to a private area and to all the content of the site.

The customer guarantees the accuracy of the information provided for the purposes of creating his customer account. The customer is solely responsible for the preservation and confidentiality of his/her login and password, which are strictly personal and confidential. The customer undertakes to take all necessary steps to ensure that this confidentiality is maintained, and in particular to change it regularly. Any use of the password is presumed to be made in the customer’s name. When placing an order, the customer expressly acknowledges having read these terms and conditions and accepts them unreservedly. Lapharmaciedepierre.fr reserves the right to adapt or modify these terms and conditions at any time. They will then apply to orders placed after their publication online. In any event, the version of the general terms and conditions of sale binding on the customer is the one accepted by the latter at the time of order validation. The general terms and conditions are permanently accessible in the online sales area under the heading General terms and conditions of sale. Lapharmaciedepierre.fr is the name of the website of Pharmacie du Soleil located in Aigues Mortes in the Gard department, which is a retailer and as such, any resale of products purchased on the site is strictly prohibited. Lapharmaciedepierre.fr reserves the right to refuse any order whose size and/or repetition could lead to the conclusion that it is not a retail sale. The customer will then be notified and reimbursed for the order.

All customers accessing the MY ACCOUNT service can consult, modify or add to their contact details, profile and password, check for the history of their most recent orders placed on the Site, check for the status of said orders, and consult and print for the history of their purchases.

Lapharmaciedepierre.fr may suspend access to the Services and send a notice to the Customer in the event of non-payment, abusive returns or if the Customer disseminates on the Site any content contrary to the law and/or public order, and in particular, without this list being exhaustive, any content that is violent, pornographic, racist, anti-Semitic, xenophobic, infringing on respect for the human person or its dignity, infringing on privacy, infringing on copyright, neighboring rights, trademark rights, or personality rights of third parties. Lapharmaciedepierre.fr may automatically delete the Customer’s account.

Article 2. Online sales and services

Pharmaciedepierre.com offers an online shopping service for parapharmacy products.

2.1 – Prices for products

Products on sale at, including medicines, come directly from stock at lapharmaciedepierre.com

The prices indicated on the site are in euros and include the value-added tax (VAT) applicable on the day of the order. Any change in the VAT rate will be passed on. Prices do not include processing and shipping costs. The mode of transport and its cost vary according to the weight of the order. The shipping costs applicable to the customer’s order are communicated during the ordering process.

All orders are payable in euros by the following methods of payment: CB, Mastercard, Visa, American Express. Bank details are known only to the Crédit Agricole server, and no payment details are stored on the lapharmaciedepierre.fr website.

Lapharmaciedepierre.com reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the prices in force at the time orders are registered, subject to availability.

Products remain the property of lapharmaciedepierre.com until full payment.

2.2 – Product availability

Product offers and prices are valid as long as they are visible on the site, while stocks last. Should a product be temporarily unavailable after an order has been placed, the customer will be informed by e-mail or post as soon as possible.

In the event that one of the products ordered is out of stock, lapharmaciedepierre.com reserves the right to offer an equivalent product in terms of properties, therapeutic indication and composition. The customer is then free to accept or not the proposed equivalent product or to be informed of the product availability delay. The customer will then be asked if he accepts the new delivery date or if he prefers to be reimbursed for his purchase.

2.3 – Ordering

Orders are placed directly on lapharmaciedepierre.fr. Any order implies acceptance of the prices and descriptions of the products. Orders must be confirmed by lapharmaciedepierre.com.

Lapharmaciedepierre.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order. Furthermore, lapharmaciedepierre.fr reserves the right to refuse orders and consequently deliveries without having to justify its decision in the event of a problem with the functioning of the database. This includes all attempts at fraud or circumvention of the verification protocols put in place to ensure customer security. There is no minimum purchase threshold.

2.4 – Product information

The photographs and other graphic illustrations of the products presented on the site have a merely indicative value, the customer being fully informed that the images, photos and colors of the items offered for sale may in particular not correspond to the actual colors under the effect of the Internet browser and the screen used.

Article 3 – Validation

The customer must accept the general sales conditions before payment. These terms and conditions are equivalent to an electronic contract. Validation of any order therefore implies acceptance of the General Sales Conditions. The Customer acknowledges that the data recorded by lapharmaciedepierre.fr constitutes proof of all transactions between lapharmaciedepierre.fr and its Customers.

Article 4 – Delivery and collection

The customer may choose a delivery method from among those proposed by the site. The cost is specified when the order is placed. In particular, customers may choose to have their order delivered to their home address or to collect it from a Colissimo delivery point.

Delivery

The times indicated are the usual average times and correspond to processing and delivery times. Lapharmaciedepierre.fr cannot be held responsible for the consequences of late delivery. In the event of items being delivered on different dates depending on their availability, the delivery period is based on the longest period. However, Lapharmaciedepierre.com reserves the right to split deliveries. Shipping and handling charges will only be invoiced for a single shipment. Products are delivered to the address provided by the Customer at the time of ordering. The delivery address may differ from the billing address.

In the event of an erroneous address, lapharmaciedepierre.fr cannot be held responsible and reserves the right to stop the ordering process and/or cancel the customer’s order by refunding the products excluding shipping costs.

The shipment can take place after acceptance by the Customer and full payment of the price.

The sale and delivery of all products are limited to the European Economic Area and the European Free Trade Association (EFTA). European Economic Area (EEA): Austria, Belgium, Bulgaria, Cyprus (Greek part), Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Iceland, Liechtenstein, Norway, United Kingdom. EFTA: EEA + Switzerland, Norway, Iceland.

In the event of the Customer’s absence or of an error in the delivery address making delivery impossible, it is the Customer’s responsibility to agree a new delivery with the transporter. Any additional costs thus incurred will be charged to the Customer. If the Customer is absent at the time of delivery, or if he/she does not collect the colis, the administrative costs and transport costs (outward and return) will not be reimbursed to the Customer.

Article 5 : Order tracking

A customer service is available, enabling customers to carry out the following operations:

  • consult the status of the order or request information relating to the order;
  • order-related complaints ;
  • “after-sales service” requests;
  • requests for information or general questions.

For any questions relating to order tracking, the customer can contact Customer Service on 04 66 53 61 30 (cost of a call to a landline in mainland France) from Monday to Friday, 9.30am to 12pm and 2.30pm to 6.30pm.

5.1 – Claims

At the time of delivery, the customer is particularly advised to check the condition of and the conformity of the product delivered, before signing the delivery note. In the event of any damage to the good delivered, the Customer must refuse delivery. Verification of the product delivered is deemed to have been carried out once the Customer or any person authorized to receive the product has signed the delivery note.

In the event of non-conformity of the parcel, it must be refused. Products which do not conform to the order or which have defects may be claimed by the purchaser. This claim must be made within 7 working days of delivery. Any claim made after this deadline will not be processed and lapharmaciedepierre.fr cannot be held responsible. Complaints may be made by e-mail to contact@lapharmaciedepierre.fr, and must include a photo of the products concerned. If the claim is justified, the returned product may be refunded or exchanged within 30 days of receipt of the returned products. Products that have been opened, damaged or soiled by the buyer will not be eligible for a refund or exchange. In the event of abusive returns, lapharmaciedepierre.fr reserves the right to refuse any further orders.

In the event of an order preparation error, i.e. if the customer has been delivered a product different from the one ordered, the customer must inform lapharmaciedepierre.com by e-mail. In this case, lapharmaciedepierre.com will pay for the return shipping costs and the correct product will be sent to the customer free of charge.

5.2 – Withdrawal – information and form

For all orders placed online at lapharmaciedepierre.fr, the customer has the right to cancel the order, without giving any reason, within 14 days from the date of delivery of the order.

The following products are not subject to the right of withdrawal:

  • damaged goods,
  • goods made to order, such as officinal, magistral and homeopathic preparations,
  • goods that deteriorate or perish quickly, such as groceries and fresh produce,
  • goods which the customer has opened or from which the film and/or seal has been removed, and which cannot be returned for reasons of hygiene,
  • goods sold in sets cannot be returned separately.

To exercise his right of withdrawal, the customer must notify lapharmaciedepierre.fr of his decision to withdraw by means of a request specifying the date and order number. In order for the withdrawal period to be respected, it is sufficient to transmit the notification relating to the exercise of the right of withdrawal before expiry of the withdrawal period. This right of withdrawal is exercised without penalty, with the exception of return costs. In the event of exercising the right of retraction, the Customer has the choice of requesting either a refund of the sums paid, or an exchange of the product. In the case of an exchange, the return will be at the Customer’s expense.

In the event of withdrawal, the customer will be reimbursed no later than fourteen days from the date of receipt of the notification, using the same means of payment as that used for the initial transaction; this reimbursement will not incur any costs for the customer. Lapharmaciedepierre.fr may defer reimbursement until the order has been returned by the Customer (directly to the pharmacy or on receipt in the case of shipment – tracked shipment is recommended). The customer must return the order no later than fourteen days after notification of the retraction request. This deadline is deemed to have been met if the goods are dispatched before the fourteen-day period has expired. The customer bears the direct cost of returning the goods.

Article 6. Warranties – Liability

In the event of an obvious error between the characteristics of the product and its representation and/or the conditions of sale, lapharmaciedepierre.fr shall not be held liable.

In the event of hypertext links pointing to other sites from lapharmaciedepierre.com, shall not be held responsible for the content of the information provided on these sites after activation of these links.

Access to third-party sites via hypertext links published on the Site is at the Customer’s own risk. Consequently, the Customer expressly waives lapharmaciedepierre.fr’s liability for any direct or indirect damage that may result from access to these sites, regardless of the nature and extent of the damage suffered.

In particular, and without this list being limitative, the responsibility of lapharmaciedepierre.fr shall not be held liable either for the quality and/or specifications of products and services sold by third-party sites, for payment transactions carried out on these sites, or in respect of any loss of documents, data and files resulting from the use of these sites, nor for any possible infringement of privacy. or other code, files, programs or data designed to interrupt, destroy or limit the functionality of any software, computers or telecommunication tools that may be received by through these sites.

In the case of purchases on a professional basis, lapharmaciedepierre.com will not be held liable for any indirect damage including operating loss, loss of profit, loss of chance, damages or expenses.

Article 7. Intellectual property rights

Any unauthorized use of the Site’s Graphic Charter and/or its Contents constitutes an act of copyright infringement and/or infringement of distinctive signs and renders the Customer criminally and civilly liable on the basis of copyright infringement and/or infringement of distinctive signs.

All photos of articles on the site are the exclusive property of lapharmaciedepierre.fr, any copy, recording for use professional or private are liable to prosecution under the law.

Article 8. Data protection / Personal and health data

In France and Europe, personal health data is protected by law. Lapharmaciedepierre.fr is an extension of La Pharmacie du Soleil, a pharmacy specializing in the retail sale of medicines and medical equipment.

Lapharmaciedepierre.com undertakes not to divulge to third parties any information that you provide. This information is confidential. It will only be used to process your order and to reinforce and personalize the communication and product offer reserved for Pharmacie Du Soleil customers, in particular by means of newsletters from the www.lapharmaciedepierre.com site to which you have subscribed, as well as to personalize the site according to your centers of interest.

In accordance with the law of January 6, 1978, the customer has a right of access, of interrogation, modification, correction and suppression of its data which allows him, if necessary, to make rectify, supplement, update, lock or erase the personal data concerning it which are inexact, incomplete, equivocal, out-of-date or whose collection, use, communication or conservation is prohibited.

Customers also have the right to object to the processing of their data for legitimate reasons, as well as the right to object to their data being used for prospecting purposes, in particular commercial prospecting.

Article 9. Modification of these terms and conditions of sale

Lapharmaciedepierre.fr reserves the right to modify the GTC at any time.

Consequently, lapharmaciedepierre.fr invites its Customers to refer to these terms and conditions each time they visit the Site in order to be aware of the latest version, which is permanently available online on the Site. Customers are then free not to access the Services if the conditions do not suit them.

Customers who do not wish their contractual relationship to be governed by the new version of the T&Cs, must notify us accordingly and, as from the date on which the new version takes effect, they must cease to use the Services.

Any modification will take effect immediately and will only apply to customers using the Services after the said modification.

Article 10. Applicable law and competent jurisdiction

These CGV are governed by French law. In the event of any dispute arising from the interpretation, validity or consequences of these GTC, and in the absence of any prior amicable solution, the French courts shall have exclusive jurisdiction. In the event of a dispute arising from the interpretation or execution of these terms and conditions, the competent court will be that of the defendant’s place of domicile or, at the plaintiff’s option, the place of actual delivery of the Product.

In accordance with l’article R.631-3 du Code de la consommation, the consumer is informed that he may, in addition to one of the courts with territorial jurisdiction under the Code of Civil Procedure, choose the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the damaging event.
